California AG sues automakers over vehicle emissions

SACRAMENTO, Calif. (AP) — California is suing the auto industry over tailpipe emissions, marking the first time a state has sought monetary damages for the impact of global warming by vehicles.

Attorney General Bill Lockyer on Wednesday sued the six largest U.S. and Japanese automakers, claiming they have causing millions of dollars in damage by creating greenhouse gases.

Lockyer is suing on the theory that greenhouse gases are a "public nuisance" under both California and federal law, an argument similar to one being pursued in a case before the 2nd U.S. District Court of Appeals in New York.

This is probably related to an attempted power grab by California a couple years ago. The U.S. government prohibits individual states from setting fuel economy standards but does allow states to regulate certain pollutants. So California tried to set carbon dioxide emission rates but was blocked by the feds on the grounds that this was simply a backhanded way of regulating fuel economy (which it was).

But this takes the battle to a whole new creative level. It is obviously a publicity stunt doomed to failure because even VERY liberal judges will have a hard time bending laws far enough to make this lawsuit comply with U.S. laws, and there is NO WAY the Supreme Court would ever rule in his favor. Probably this A.G. is trying to build base support for a future run at a higher office, such as Governor of CA.

Greenhouse Gases are a public nuisance. Is there anyone in your family with Asthma? If so I hope they have health insurance. The California A.G. is correct. He is protecting the Citizens of his state. I buy American Cars & Trucks and always have. They are a problem with pollution & the Execs avoided the problem for years. Now they are beginning to do something about it since their so called "Republican" friends are ditching them. Americans can only bully American car buyers & the World for so long. Ask what cars the Big 3 drive & their Execs too. Hardly an American in the bunch. Go look in their driveways. Their Execs probably shop at Walmart too helping to export more American jobs. How can Americans buy a new car with $8 an hour salaries and part time jobs with no benefits?
